Only Milka is allowed to use purple in Germany
The Federal Supreme Court of Germany (BGH) has ruled in favour of Kraft Foods brand Milka in a dispute with the Verdener Keks- und Waffelfabrik about a colour issue. An assortment of wafers and biscuits sold in a purple bag in stores has as a result been taken off the shelves. In the opinion of the court, the colour purple is associated with the Milka brand to such a degree that there is a high probability of confusion. The lawyer acting on behalf of the wafer company criticised the idea of according colours brand name status and accused big concerns of claiming the colours of the rainbow for themselves
